5. Nature of the Service - Important Disclaimers
5.1 Psychometric Assessment Limitations
The MAPS assessment measures work preferences, not personality traits, abilities, clinical conditions, or competencies. Assessment results describe tendencies and preferences at a point in time and should be interpreted as one input among many when making decisions. Specifically:
- MAPS results are not a clinical, psychological, or diagnostic tool. They do not measure intelligence, aptitude, mental health status, or personality disorders.
- Preference profiles represent positions on a preference scale and are descriptive, not prescriptive. No profile is inherently "better" or "worse" than any other.
- Preferences may change over time. A single assessment result should not be treated as a permanent or fixed classification of any individual.
- Assessment results should not be the sole basis for employment, promotion, termination, or any other decision that materially affects an individual's livelihood or wellbeing.
5.2 AI-Generated Content Disclaimer
The Service uses artificial intelligence, including large language models provided by third-party providers (currently Anthropic), to generate narrative summaries, comparison reports, and other outputs ("AI Outputs"). You acknowledge and agree that:
- AI Outputs are generated by machine learning models and may contain inaccuracies, omissions, or errors. They should be treated as informational, not definitive guidance.
- AI Outputs are based on the data you provide (including survey responses) combined with authored preference content. They are not the result of human professional judgement.
- We do not guarantee the accuracy, completeness, suitability, or reliability of any AI Output for any particular purpose.
- AI Outputs may vary each time they are generated, even from the same inputs. This is a normal characteristic of large language models.
- Your data may be processed by our third-party AI provider (Anthropic) in accordance with their data processing terms. We do not use your data to train AI models, and we require the same commitment from our providers.
5.3 Not Professional Advice
The Service and its outputs are not a substitute for:
- Therapy, counselling, or mental health treatment. If you are experiencing a mental health crisis, please contact a qualified mental health professional or your local emergency services immediately.
- Medical advice. Do not rely on the Service for health-related decisions.
- Legal advice. The Service does not provide legal counsel. Consult a qualified solicitor or legal advisor for legal matters.
- Financial advice. The Service does not provide regulated financial advice. Consult a qualified financial advisor for financial decisions.
- Employment law advice. While the Service may describe workplace preferences, it does not constitute employment law guidance. Seek qualified legal advice for employment disputes or decisions.
- Professional HR consultancy. AI-generated summaries about recruitment, team composition, or role matching are informational aids, not professional HR decisions.
You are solely responsible for evaluating the appropriateness of any AI Output and for any actions you take based on it.
5.4 User Responsibility for Decisions
You acknowledge and agree that:
- All decisions made using insights, reports, comparisons, recommendations, or outputs from the Service are your sole responsibility.
- The Service provides information and perspectives to support your decision-making, but the final decision and its consequences rest entirely with you.
- If you use the Service in an organisational context (e.g., for recruitment, team building, or performance management), you are responsible for ensuring that your use complies with applicable employment law, equality legislation, and your own organisational policies.
6. Payments, Credits, and Subscriptions
6.1 Payment Terms
Access to the Service may be free (with limited functionality on the free tier), or available through recurring monthly subscriptions, depending on the tier selected. All payments are processed securely through Stripe. By subscribing, you agree to pay all applicable fees and taxes.
6.2 Free Experience
New users may be eligible for a free experience that includes access to core features at no cost. No credit card is required. There is no time limit. By starting the free experience, you acknowledge:
- The free experience provides access to the MAPS assessment and your individual preference profile (myMAP) at your own pace.
- Access to advanced comparison, team, and talent features will require a paid subscription.
- Your data and assessment history are preserved.
- Free experience eligibility and terms are subject to change at any time.
6.3 Subscription Terms
Subscriptions are billed monthly and renew automatically until cancelled. By subscribing, you acknowledge:
- You will be charged the applicable monthly fee on the same date each month.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- Subscription pricing may be changed with reasonable advance notice. Continued use after a price change constitutes acceptance of the new pricing.
- Subscriptions are non-transferable.
6.4 Regional Pricing
We may offer adjusted pricing for customers in certain regions to reflect local purchasing power. Regional pricing is available exclusively to businesses and individuals operating in the applicable region. By subscribing at a regional price, you confirm that your primary place of business or residence is in the region associated with that pricing. We reserve the right to verify your location and adjust your subscription to standard pricing if we determine that regional pricing has been applied incorrectly.
6.5 Refund Policy
All purchases are generally non-refundable. However, if you are a consumer in the United Kingdom, you have a statutory right to cancel a digital content purchase within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, provided that you have not begun to use the Service. Once you access premium features, you acknowledge that you have requested immediate performance and waive your right of withdrawal to the extent permitted by law.
7. Privacy and Data Protection
Our use of your data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to our data collection and usage practices outlined in the Privacy Policy.
7.1 Infrastructure Security and Service Continuity
The Service is hosted on enterprise-grade cloud infrastructure (Render.com on Amazon Web Services eu-central-1, Frankfurt, Germany) with the following protections:
- Encryption: All data in transit is encrypted with TLS 1.2+. All data at rest is encrypted with AES-256. Encryption keys are managed via AWS Key Management Service with automatic rotation.
- Database resilience: Our PostgreSQL database is managed with automated patching, automated failover to standby replicas, and continuous health monitoring. No database port is exposed to the public internet.
- Backup and recovery: Automated daily backups with point-in-time recovery capability, supplemented by application-level export tools. The application server is stateless; all persistent data resides in the independently redundant database.
- Network security: Web Application Firewall (WAF), load balancing, private networking for internal services, rate limiting, and Content Security Policy headers.
- Compliance: Our hosting provider holds SOC 2 Type 2 Attestation of Compliance. Sariio Limited processes data in accordance with UK GDPR and the Data Protection Act 2018.
- Incident response: We maintain a defined incident response protocol covering detection, triage, containment, investigation, notification (within UK GDPR statutory timeframes), remediation, and post-incident review.
While we implement robust security measures, we do not warrant that the Service will be uninterrupted or entirely free from security vulnerabilities.
8. Third-Party Services
The Service integrates with third-party providers to deliver its functionality. These currently include:
- Anthropic: Provides the large language models that power AI-generated summaries and comparison reports. Your preference data is transmitted to Anthropic for processing. Anthropic processes this data under their data processing agreement with us and does not use it for model training.
- Stripe: Processes payments securely. Your payment information is handled directly by Stripe and is not stored on our servers.
- Render.com: Provides the hosting infrastructure on Amazon Web Services eu-central-1 (Frankfurt, Germany).
- Resend: Provides transactional email delivery.
We may add, change, or remove third-party providers at our discretion. Material changes to how your data is processed by third parties will be reflected in updates to these Terms and our Privacy Policy.
9. Intellectual Property
The MAPS methodology, assessment instruments, factor definitions, and all associated content are the intellectual property of Sariio Limited. You may not reproduce, distribute, or create derivative works from our intellectual property without prior written consent.
Reports, insights, and AI Outputs generated by the Service for your account are provided for your personal or organisational use. You may share individual reports with colleagues or stakeholders, but you may not systematically reproduce or commercially redistribute them.
10. Liability Disclaimers
The Service provides insights, summaries, and AI-generated outputs based on survey responses and authored preference content. These are for informational and developmental purposes only and should not be relied upon for decisions affecting your health, welfare, financial well-being, or legal standing. We disclaim liability for any outcomes resulting from the use of our reports or AI Outputs.
Without limiting the foregoing:
- We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.
- We do not warrant the accuracy, reliability, or completeness of any AI Output.
- We are not responsible for any decisions made or actions taken by you or your organisation based on information provided by the Service.
11. Indemnification
You agree to indemnify, defend, and hold harmless Sariio Limited, its directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service or any AI Outputs in a manner not contemplated by these Terms.
- Your reliance on AI Outputs for professional, medical, legal, financial, or employment decisions.
- Any breach of these Terms by you.
- Your use of assessment results in a manner that discriminates against, harms, or unfairly disadvantages any individual.
12. Limitation of Liability
To the fullest extent permitted by law:
- Sariio Limited shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
- Our total aggregate liability for all claims arising from your use of the Service shall not exceed the greater of (a) the amount paid by you to Sariio Limited in the twelve (12) months preceding the claim, or (b) one hundred pounds sterling (GBP 100).
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
13. Termination
We reserve the right to suspend or terminate your account if you breach these Terms or engage in prohibited activities. You may terminate your account at any time by contacting us.
Upon termination, your right to use the Service ceases immediately. We will retain your data in accordance with our Privacy Policy and applicable law. You may request export or deletion of your data prior to or following termination.
14. Modifications to the Service or Terms
We may update the Service or these Terms at our discretion. We will notify you of material changes by email or through the Service. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should discontinue use of the Service.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Before initiating formal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation. If negotiation is unsuccessful within 30 days, either party may pursue resolution through the courts or, by mutual agreement, through binding arbitration in accordance with the UK Arbitration Act 1996.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
17. Partner Programme Terms
The following additional terms apply to users who participate in the Sariio Partner Programme ("Partners"). These terms supplement the general Terms above and, in the event of conflict, the more specific Partner terms shall prevail.
17.1 Partner Branding - Acceptable Use
Partners may upload custom branding assets (including logos, display names, taglines, and colour schemes) to personalise client-facing surfaces of the Service. By uploading branding assets, you represent and warrant that:
- You own or have the legal right to use all uploaded logos, images, and text.
- Your branding does not infringe any third party's intellectual property, trademark, or copyright.
- Your branding does not contain offensive, discriminatory, sexually explicit, violent, or otherwise objectionable content.
- Your display name and tagline do not impersonate or misrepresent affiliation with any other company, brand, or organisation.
- Your branding complies with all applicable laws and regulations, including advertising standards and consumer protection laws.
17.2 Logo Requirements
Uploaded logos must meet the following technical specifications:
- File format: PNG, JPG/JPEG, SVG, or WebP only.
- File size: Maximum 2MB.
- Dimensions: Minimum 100 x 100 pixels, maximum 2,000 x 2,000 pixels.
- Aspect ratio: Square or landscape orientation recommended. Extreme aspect ratios (wider than 4:1 or taller than 1:2) are not permitted.
Logos that do not meet these specifications will be rejected automatically. Logos are also subject to automated content moderation and may be flagged for manual review.
17.3 Sariio Attribution
All partner-branded surfaces must retain the "Powered by Sariio" attribution. Partners may not remove, obscure, or alter the Sariio attribution badge. The Sariio name, logo, and brand identity remain the exclusive property of Sariio Limited at all times.
17.4 Content Review and Enforcement
Sariio Limited reserves the right to review any partner branding assets at any time. If we determine that your branding violates these terms, the following enforcement process applies:
- Notification: We will notify you by email of the specific violation(s) and the required corrective action.
- Remediation period: You will have fourteen (14) calendar days from the date of notification to replace or remove the non-compliant branding assets.
- Interim measures: During the remediation period, we may, at our discretion, temporarily replace your branding with default Sariio branding on client-facing surfaces to protect end users and the platform's reputation.
- Failure to remediate: If you fail to resolve the violation within the 14-day period, we reserve the right to permanently remove your non-compliant branding assets, suspend or terminate your Partner account, transfer management of your client organisations to Sariio directly, or suspend or terminate any applicable revenue share payments.
17.5 Immediate Removal
Notwithstanding the remediation period described above, Sariio Limited reserves the right to immediately remove branding assets and suspend Partner access without prior notice in cases of branding that contains illegal content, constitutes hate speech or severe discrimination, creates a clear risk of consumer confusion, or poses an imminent risk to users or Sariio Limited's reputation.
17.6 Revenue Share and Financial Terms
Partners receive a recurring revenue share (currently 70%) on qualifying client organisation subscriptions managed through their Partner account. Revenue share is subject to the following conditions:
- Revenue share is calculated on net subscription payments after any refunds, chargebacks, or payment processing fees.
- Revenue share payments are processed monthly via Stripe Connect.
- Revenue share may be suspended or terminated if the Partner breaches these Terms, including branding guidelines.
- Revenue share percentages and terms may be amended with 30 days' written notice.
17.7 Client Organisation Transition
In the event of Partner termination (whether voluntary or for cause), client organisations managed by the Partner will be transitioned to direct Sariio management. During this transition:
- Client organisations and their users will retain full access to the Service without interruption.
- Partner branding will be replaced with default Sariio branding.
- Outstanding revenue share payments for the period prior to termination will be settled within 30 days.
- No new revenue share will accrue after the effective date of termination.
18. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Sariio Limited regarding your use of the Service and supersede all prior agreements, understandings, and communications.
